Can I exclude my child from my will?

On Behalf of | Aug 14, 2024 | Estate Planning |

Not everyone wants to leave their children something when they die. In Texas, you are under no obligation to leave your kids a dime, unless they are still minors when you die, in which case they have a right to some of your estate.

So, assuming your kids have already turned 18, how can you disinherit them?

Say what you are doing in your Will

If you do not make any mention of your child in the will there is always the chance they could successfully contest it. They could claim that you suffered a senior moment when making your will and forgot to include them. By specifically stating that you wish to leave them nothing, you make it clear you intended to leave them out and did not just forget.

Disinheritance is not the only option if you are unhappy with your child or your child’s life choices. An experienced estate planning attorney can help you develop a plan and consider your options.
